A BILL to amend and reenact §4-2-6 of the Code of West Virginia, 1931, as amended, relating to providing a mechanism for the independent evaluation of revenue estimates by West Virginia and Marshall Universities’ business colleges.

Be it enacted by the Legislature of West Virginia:


That §4-2-6 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 2. LEGISLATIVE AUDITOR; POWERS; FUNCTIONS; DUTIES; COMPENSATION.


§4-2-6. Preparation of budgets and reports.

(a) The Legislative Auditor shall prepare an appropriate budget for each spending unit, for each biennium for which appropriations are sought, in such form and with such itemization and other information as the committee shall prescribe, at least thirty days prior to any legislative session, and submit the same to the committee with the appropriate recommendations, together with such other findings and reports deemed necessary or required by the committee. He The Legislative Auditor shall also report to the committee any misapplication of state funds and any erroneous, extravagant or unlawful expenditures by any spending unit, together with such other findings and reports as the committee shall require.

(b) The Legislative Auditor shall forward copies of the estimates received under section eleven, article two, chapter eleven-b of this code to the presidents of West Virginia University and Marshall University for review by qualified personnel in the universities’ business schools. The business schools shall review the estimates and evaluate the accuracy of the estimates and provide written reports containing the results of their evaluations to their respective president. The presidents shall forward copies of reports to the Legislative Auditor and to the Chairs of the Senate Committee on Finance and the House of Delegates Committee on Finance.

 

NOTE: The purpose of this bill is to provide a mechanism for the independent evaluation of revenue estimates by West Virginia and Marshall Universities’ business colleges.
