A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto two new sections, designated §30-1B-2a and §30-1B-2b, all relating to provisions applicable to military members and their spouses.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto two new sections, designated §30-1B-2a and §30-1B-2b, all to read as follows:

ARTICLE 1B. PROVISIONS APPLICABLE TO MILITARY MEMBERS AND THEIR SPOUSES.

§30-1B-2a: Definitions


As used in this article:

“Licensing” means any required training, education, or fee to work in a specific profession.

“Licensing authority” means an agency, examining board, credentialing board, or other office with the authority to impose occupational fees or licensing requirements on any profession.

“Military families” means any active duty service members and their spouses, and honorably discharged veterans and their spouses. Surviving spouses of deceased service members who have not remarried are also included.

“Occupational fee” means a fee or tax on professionals or businesses that is charged for the privilege of providing goods or services within a certain jurisdiction.

“Political subdivision” means a city, town, village, or county.

§30-1B-2b: Waiver of Licensing Fees for Military Families.


(a) All state and political subdivision licensing authorities shall waive all occupational fees and fees from licensing requirements for military families.

(b) Individuals seeking a waiver of occupational fees and fees from licensing requirements must apply to the appropriate licensing authority in a format prescribed by the licensing authority. The licensing authority shall process the application within thirty days of receiving it from the applicant.

(c) The licensing authority may propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a, for the implementation of this section.

 

NOTE: The purpose of this bill is to provide a waiver of professional and occupational licensing fees for military families.
