A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §20-1-15, relating to requiring the Division of Natural Resources to create and publicly post an inventory of areas in state-managed forests and wildlife areas where the operation of off-highway vehicles by the public is permitted.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §20-1-15 to read as follows:

ARTICLE 1. ORGANIZATION AND ADMINISTRATION.

§20-1-15. Comprehensive inventory of state-managed areas open to off-highway vehicles.

(a) The Legislature finds that publicizing recreational opportunities in this state for off-highway vehicle enthusiasts is an important tool to promote tourism in the state and strengthen the local economy.

(b) For the purposes of this section “off-highway vehicle” refers to a vehicle designed for off-highway use and includes all-terrain vehicles and utility-terrain vehicles as defined by section two, article fifteen, chapter twenty of this code.

(c) On or before December 31, 2017, the Division of Natural Resources shall complete an inventory of all state-managed areas including, but not limited to, roads, trails and wildlife management areas, where the operation of off-highway vehicles by the public is permitted.  The inventory shall meet the following requirements:

(1) Identify the location, condition, and development level of each road, trail or area included in the inventory;

(2) Identify the types of motorized and nonmotorized vehicles permitted on each road, trail or area included in the inventory; and

(3) Identify any seasons and times during which use of a road, trail or area included in the inventory is restricted.

(d) The Division of Natural Resources shall annually post to its website the inventory required by subsection (a) of this section, as well as a comprehensive map of the roads, trails and areas listed in the inventory.

NOTE: The purpose of this bill is to require the Division of Natural Resources to create and publicly post a list of state-managed areas where the operation of off-highway vehicles by the public is permitted.

Strike-throughs indicate language that would be stricken from a heading or the present law and underscoring indicates new language that would be added.
