A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-5B-2a, relating to requiring outpatient surgical facilities to meet the same facility and surgical standards as ambulatory surgical facilities; and providing rule-making authority.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-5B-2a, to read as follows:

ARTICLE 5B. HOSPITALS AND SIMILAR INSTITUTIONS.

§16-5B-2a. Outpatient surgical facility standards; rule-making.

    (a) For purposes of this article an outpatient surgical facility operating in the State of West Virginia is an “ambulatory surgical facility” as that term is defined by section one of this article and is subject to the same minimum facility and surgical standards as required by this article for other ambulatory surgical facilities.

    (b) The Department of Health in conjunction with the Department of Health and Human Resources shall propose rules for legislative approval in accordance with article three, chapter twenty-nine-a of this code to implement the provisions of subsection (a) of this section. The rules shall, at a minimum, impose minimum facility and surgical standards and require inspections by the Department of Health and Human Resources.



    NOTE: The purpose of this bill is to require outpatient surgical facilities to meet the same facility and surgical standards as ambulatory surgical facilities. The bill provides rule-making authority.
