A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-2D-4c, relating to exempting drug rehabilitation facilities from certificate of need requirements.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-2D-4c, to read as follows:

ARTICLE 2D. Certificate of Need.

§16-2D-4c. Certificate of need; exemption for drug rehabilitation facilities.


(a) For the purposes of this section, “drug rehabilitation facility” means a healthcare facility, the primary purpose of which is to provide medical or psychological treatment to patients suffering or recovering from drug or alcohol addiction or abuse.

(b) Notwithstanding any provision of this article and any rule issued by a state agency, a certificate of need is not required for the construction, renovation, maintenance or operation of a drug rehabilitation facility.

 

NOTE: The purpose of this bill is to exempt drug rehabilitation facilities from certificate of need requirements.
