A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §24-2-19, relating to implementing a requirement for the Public Service Commission to report to the Joint Standing Committee on Government Organization.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §24-2-19, to read as follows:

ARTICLE 2. POWERS AND DUTIES OF PUBLIC SERVICE COMMISSION.

§24-2-19. Reporting requirement.
The Public Service Commission shall prepare and present annually to the Joint Standing Committee on Government Organization of the West Virginia Legislature a report which includes:
(1) Data on the cost effectiveness of the current mechanism of rate regulation for all industries the Public Service Commission regulates;
(2) Specific reference to the impact upon West Virginia ratepayers of alternate rate setting mechanisms, including but not limited to, participation in competitive markets as discussed in section eighteen of this article, and how competitive market strategies or alternate rate setting mechanisms, or both, would be implemented;
(3) A list of actions which could be undertaken by the Public Service Commission which could result in lower rates for West Virginia ratepayers; and
(4) Other information which from time to time is specifically requested for inclusion in this report by the Joint Standing Committee on Government Organization of the West Virginia Legislature.



NOTE: The purpose of this bill is to provide guidelines for annual reporting by the Public Service Commission to ensure that it is providing economic benefit to West Virginia ratepayers and is fulfilling its mandates in an efficient manner.
