A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §19-23-10a, relating to eliminating the West Virginia Greyhound Breeding Development Fund and transferring that money and future money that would have gone to that fund one-half to the Public Employees Insurance Agency and one-half to the Department of Health and Human Resources for the intellectual developmental disability waiver program.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §19-23-10a to read as follows:

ARTICLE 23. HORSE AND DOG RACING.


§19-23-10a. West Virginia Greyhound Breeding Development Fund eliminated; transfer of present and future money.

(a) The “West Virginia Racing Commission-Special Account-West Virginia Greyhound Breeding Development Fund” created in section ten of this article is hereby abolished and any money in the fund on the effective date of this section shall be transferred by the Racing Commission one-half to the Public Employees Insurance Agency and one-half to Intellectual Developmental Disability (IDD) Waiver Program of the Department of Health and Human Resources.  Any money directed to be deposited into the Greyhound Breeding Development Fund under the following code sections shall instead be deposited in the same proportions as directed above. The code sections are sections twelve-b, thirteen, thirteen-b and thirteen-c of article twenty-three, chapter nineteen of this code; section eighteen-a, article twenty-two, chapter twenty-nine of this code; sections ten and ten-b, article twenty-two-a, chapter twenty-nine of this code; and section twenty-seven, article twenty-two-c, chapter twenty-nine of this code.

(b) The Department of Health and Human Resources shall provide services at the levels contained in the IDD waiver manual in effect on April 1, 2015.

 

NOTE: The purpose of this bill is to abolish the Greyhound Breeding Development Fund and to transfer those funds one-half to the Public Employees Insurance Agency and one- half to the IDD waiver program of DHHR..
