A BILL to amend and reenact §18-2-4 of the Code of West Virginia, 1931, as amended, relating to requiring the appointment of the State Superintendent of Schools be with the advice and consent of the Senate.
Be it enacted by the Legislature of West Virginia:
    That §18-2-4 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 2. STATE BOARD OF EDUCATION.
§18-2-4. Organization; appointment of State Superintendent of Schools; appointment and duties of secretary.
     
(a) At its first regular meeting in every year the state board shall elect one of its members as president, who may serve an unlimited number of terms, but no more than two consecutive terms, and one as vice president of the board.
     (b) The state board shall appoint, subject to the advice and consent of the Senate, a State Superintendent of Schools. The State Superintendent shall be is the chief executive officer of the state board and, subject to its direction, shall execute its policies.
     (c) The state board shall appoint a secretary and fix the secretary's salary to be paid out of the General School Fund upon warrants drawn by the State Superintendent. The secretary shall keep a record of the proceedings of the state board and shall perform such other duties as it may prescribe.


     NOTE: The purpose of this bill is to require the appointment of the State Superintendent of Schools be with the advice and consent of the Senate.
