The Committee on Energy moves to amend the bill on page two, section nine, line twenty-eight, after the word “published” by inserting the words “in a newspaper of general circulation in the locality of the proposed permit area at least once a week for four successive weeks”.

And,

On page seven, section twenty, line four, after the word “electronic.” by inserting the following: “At the time of submission, the applicant shall place the advertisement in a local newspaper of general circulation in the county of the proposed surface-mining operation at least once a week for four consecutive weeks.”

And,

On page eight, section twenty, line twenty-nine, after the word “secretary” by inserting the words “in a newspaper of general circulation in the locality.

And,

On page nine, section seven-a, line five, before the word “in” by inserting the words “may be issued a certification”.

And,

            On pages thirty-four and thirty-five, section fifty-five, lines thirty-nine through forty-eight, by striking out subsection (g) in its entirety and inserting in lieu thereof a new subsection (g), to read as follows:


(g) The MSHA-approved emergency response plan (ERP) shall serve as the state-approved plan governing the storage of self-contained self-rescuers (SCSR).  At a minimum, three one-hour SCSRs shall be available for everyone reasonably likely to be on the working section at any given time. The director may issue a special assessment pursuant to §22A-1-21 of this code for failure to comply with this subsection.
