                Delegate Capito moves to amend the bill on page seven, section four, line

 sixty one, in subsection (b) by striking the words; “All workers who do not satisfy the criteria set forth in

subsection (a) of this section shall be classified as employees” and inserting in lieu thereof the words,

“The classification of all workers who do not satisfy the criteria set forth in subsection (a) of this section

shall be determined by the test set forth in Internal Revenue Service Rev. Ruling 87-41, for purposes of

classifying workers under the laws”.
