The Committee on Finance moved to amend the bill on page 3, section 14, lines 51 – 61, by striking out subsection (e) and inserting in lieu thereof a new subsection (e) to read as follows:
(e) General counsel of executive branch agencies who are contracted by an agency for 10 or more consecutive calendar years to perform legal services may purchase retroactive service credit for the time served in that capacity: Provided, That the counsel must have been regularly employed on a full-time basis requiring 12 months per year service and at least 1,040 hours of service per year in that position. Counsel shall pay the employee’s share, and the agency shall pay the employer’s share. No interest or penalty shall be applied toward the purchase of retroactive service credit in accordance with the provisions of this section where the individual was not eligible to become a member during the years for which he or she is purchasing retroactive credit or had the employee attempted to contribute to the system during the years for which he or she is purchasing retroactive service credit the contributions would have been refused by the board. No more than one year of service may be credited for all service rendered in any calendar year. Retroactive service credit purchased under this section shall be paid in full by counsel within 24 months of termination of employment or contractual obligation with the agency.
