The Subcommittee on Educational Choice moves to amend the bill on page 1, following the enacting clause, by striking everything thereafter and inserting in lieu thereof the following:
(a) A student who is lawfully educated under the homeschool provisions of West Virginia law may be considered for participation in interscholastic athletic activities governed by the West Virginia Secondary School Activities Commission, subject to the conditions of this section.
(b) Nothing in this section shall be construed to create a right to participate in interscholastic athletics. Participation shall remain a privilege subject to eligibility, safety, and conduct standards established by the West Virginia Secondary School Activities Commission.
(c) The West Virginia Secondary School Activities Commission shall retain sole authority to establish, interpret, enforce, and revoke eligibility standards applicable to homeschool students, including but not limited to academic eligibility verification, age and residency requirements, health and safety regulations, and codes of conduct and disciplinary enforcement.
(d) Homeschool students seeking participation under this section shall be affiliated with a homeschool athletic organization or program that is pre-approved by the West Virginia Secondary School Activities Commission pursuant to rules established by the Commission. The Commission may revoke such approval at any time for noncompliance.
(e) Academic eligibility for homeschool students shall be demonstrated through documentation already required under West Virginia homeschool law, including standardized assessments, certified teacher review, or county-submitted evaluations, as determined acceptable by the Commission.
(f) Participation by a homeschool student shall occur only with the approval of the receiving school’s principal or athletic director, and no member school shall be required to accept participation by a homeschool student.
(g) Homeschool students participating pursuant to this section shall be subject to the same athletic participation limits, age restrictions, transfer rules, and disciplinary standards applicable to students enrolled in member schools.
(h) This section applies only to students educated under West Virginia homeschool statutes and shall not be construed to apply to club teams, private training academies, virtual programs not recognized under state law, or non-school athletic organizations.
