A BILL to amend and reenact §17A-6-25 of the Code of West Virginia, 1931, as amended, relating to permitting inspectors working within the Division of Dealer Services of the Division of Motor Vehicles to carry a concealed weapon on duty.

Be it enacted by the Legislature of West Virginia:


ARTICLE 6. LICENSING OF DEALERS AND WRECKERS OR DISMANTLERS; SPECIAL PLATES; TEMPORARY PLATES OR MARKERS.

§17A-6-25. Inspections; authorizing inspectors carry a concealed weapon; violations and penalties.


(a) The commissioner and all law-enforcement officers of the state, acting at the commissioner's request, are hereby authorized to inspect the place of business, vehicles and pertinent records, documents and papers of any person required to be licensed under the provisions of this article to the extent deemed reasonably necessary to determine compliance with and violations of this article. For the purpose of making any such inspection, the commissioner and such law-enforcement officers are authorized, at reasonable times, to enter in and upon any such place of business and any other public garage or enclosure where vehicles are sold, stored, hired or repaired.

(b) Notwithstanding any provision of this code to the contrary, inspectors working for the Division of Dealer Services within the Division of Motor Vehicles may carry a concealed weapon while on duty: Provided, That inspectors possess a valid concealed weapons permit pursuant to §61-7-4 of this code.

(b) (c) Any person who shall violate any provision of this article or any final order of the commissioner or board hereunder shall be guilty of a misdemeanor and, the provisions of §17A-11-1 et seq. of this code governing violations of this chapter generally shall be fully applicable thereto.

 

NOTE: The purpose of this bill is to permit inspectors working within the Division of Dealer Services of the Division of Motor Vehicles to carry a concealed weapon on duty.
