A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §16-42-1, §16-42-2 and §16-42-3, all relating to establishing a system whereby pharmacies share information so that they may be alerted when an individual is attempting to go to multiple pharmacies with prescriptions from multiple doctors to obtain drugs for resale.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article, designated §16-42-1, §16-42-2 and §16-42-3, all to read as follows:
ARTICLE 42. MULTIPLE PRESCRIPTIONS ABUSE PREVENTION ACT.
§16-42-1. Title of article.

This article shall be know as the "Multiple Prescriptions Abuse Prevention Act."
§16-42-2. Purpose of article; legislative findings.
The purpose of this article is to prevent individuals from going to multiple doctors and multiple pharmacies to acquire prescription drugs so that they may then sell them by establishing a system whereby pharmacies share information so that they may be aware when an individual is seeking to acquire multiple prescriptions from different pharmacies. The Legislature recognizes that prescription drug abuse is a serious problem and that the sharing of information among pharmacies would curtail the illegal sale of prescription drugs by preventing persons from obtaining multiple prescriptions at different pharmacies.
§16-42-3. Creation of database.
The Secretary of the Department of Health and Human Resources shall develop a system to allow pharmacies to share data so that the individual pharmacies may be aware that an individual has been seeking to have multiple prescriptions for the same or similar drugs filled at multiple pharmacies. The Secretary of the Department of Health and Human Resources shall propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a of this code.

prevent individuals from going to multiple doctors and multiple pharmacies to acquire prescription drugs so that they may then sell them by establishing a system whereby pharmacies share information so that they may be aware when an individual is seeking to acquire multiple prescriptions from different pharmacies .
