A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §29-22B-1715,
relating to the prohibition of operating a video lottery game
or video lottery terminal between six a.m. and one p.m. on
Sundays; exceptions; and establishment of criminal penalties.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §29-22B-1715, to read
as follows:
ARTICLE 22B. LIMITED VIDEO LOTTERY.
§29-22B-1715. Criminal penalty for operating a video lottery
terminal during prohibited hours on Sundays.
(a) A person who operates, carries on or exposes for play a
video lottery game or video lottery terminal between six a.m. and
one p.m. on Sundays is guilty of a misdemeanor and, upon conviction thereof, shall for a first conviction be fined not less than one
thousand dollars nor more than five thousand dollars, except that,
in the case of a person other than an individual, the amount of the
fine imposed may not be less than ten thousand dollars nor more
than twenty-five thousand dollars; for a second and each subsequent
offense under this section shall be fined not less than ten
thousand dollars nor more than twenty thousand dollars, except that
in the case of a person other than an individual, the fine may not
be less than twenty-five thousand dollars nor more than fifty
thousand dollars.
(b) Nothing contained in this article shall be construed to
modify, amend, or otherwise affect the validity of any provisions
regulating racetrack video lottery as set forth in article twenty-
two-a of this chapter.
NOTE: The purpose of this bill is to prohibit persons, other
than a racetrack video lottery, from operating video lottery games
and terminals between six a.m. and one p.m. on Sundays and to
establish criminal penalties for convictions.
