Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
If enacted SB59 would amend ยง23-4-1 to provide rebuttable presumptions for certain injuries and diseases for workers compensation coverage to volunteer firefighters, municipal, county and state police officers.
The provisions of SB59 would increase the workers' compensation premium rates for Volunteer Fire Departments (VFD) and police officers and is likely to have an adverse fiscal impact on the governing bodies that employ those classifications of workers.
If the provisions of SB59 are considered to apply retroactively with regard to exposure periods, there would be an adverse fiscal impact to the Worker's Compensation Old Fund. If the provisions of SB59 are interpreted to apply to non uniformed members of the state police, SB 59 will have an adverse fiscal impact on the State Agencies Workers Compensation Fund. It is unknown at this time how significant those impacts would be on the two Funds.

Explanation of above estimates (including long-range effect):
Memorandum
If enacted, SB59 may have an adverse fiscal impact on the Worker's Compensation Old Fund and the State Agencies Workers Compensation Fund. It is not known if the provisions of SB59 would be interpreted to apply retroactively, or if the additional disease coverage being granted includes non uniformed state polices officers. Accordingly, it is not possible to quantify the extent of the increased expenses or increased workers' compensation premium rates on the two funds that could be impacted.
There would be fiscal impact to the WV State Police, as they are self-funded for uniformed state police officers and they should be contacted in order to ascertain the fiscal impact to their expenses and their budget. Any self-funded municipality or county should also be contacted to provide an estimate for the increased costs and the potential impact to their budgets.
