Effect this measure will have on costs and revenues of state government.


The Surplus Property Program under the authority of the West Virginia Purchasing Division has experienced difficulty in the past when attempting to reimburse the proceeds of the sale of state property since W.Va. Code §5A-3-45(f) requires the Surplus Property Program to reimburse the fund(s) that the property was originally acquired. In some cases, the fund no longer existed. The purpose of this legislation is to allow the Surplus Property Program to allow the spending unit to designate the fund into which proceeds from the sale of the property may be deposited. The Purchasing Division requested this legislation last year in attempt to properly reimburse the spending unit for the property retired by their agency and sold by the Surplus Property Program.

Explanation of above estimates (including long-range effect):


The amount of proceeds from sales of retired surplus property that was acquired from a fund no longer in existence is unknown. However, it does occur periodically. The Purchasing Division recommends that the Code changes to allow the proceeds to go to the proper spending unit.



Memorandum


Another bill, SB283, was introduced during the 2018 Regular Session of the Legislature relating to the same section of W.Va. Code §5A-3-45(f). It recommends the same change to allow the Purchasing Division’s Surplus Property Program to allow the spending unit to designate an alternative fund within which the proceeds must be deposited.
