Effect this measure will have on costs and revenues of state government.


The purpose of proposed Senate Bill 515 is to clarify Public Service Commission jurisdiction over water and sewer utilities owned by political subdivisions; to establish uniformity in the class of publications required by municipalities and public service districts for the revision in rates; to provide a time period for the filing of and resolution of complaints filed at the Public Service Commission regarding actions of municipalities; to clarify language in West Virginia Code ยง24-2-4b regarding reference to other Sections of the West Virginia Code pertaining to notice requirements for municipal utilities; and, addressing the time period pertaining to the filing of appeals and the resolution of such appeals of rate and construction projects decided by county commissions.

Explanation of above estimates (including long-range effect):


We are unable to identify any additional measureable or significant costs to the State or political subdivisions of the State directly associated with the changes in State law envisioned by the proposed Bill. It appears the primary focus of the Bill is to provide for a phased-approach to move primary regulation of rates, borrowing and capital projects of water and sewer systems owned by political subdivisions of the State to local governing bodies and away from the Public Service Commission of West Virginia.
