Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to establish for the regulation of electric bicycles. The bill provides for their exclusion from registration, title, insurance and driver’s license requirements. The bill provides for general regulations for their use, provide for helmet use requirements. The bill prohibits the operation of an electric bicycle under the influence of alcohol, controlled substances, and drugs. The bill requires the wearing of a helmet. The bill sets forth penalties. This bill will not have a fiscal impact on the Division. The Division is concerned that West Virginia would no longer be compliant with Title 23 USC 164 IFR-Repeat Offender Rules. Under Section 164 a State must enact and enforce a repeat intoxicated driver law that establishes, at minimum, certain specified penalties for second and subsequent convictions of driving while intoxicated or driving under the influence. Failure to enact and/or enforce such laws could result in a transfer of federal funds away from highways projects. Our concern is the language in the Bill that reads “A person owning or operating an electric bicycle is not subject to the provisions of §17A-1-1 et seq., §17B-1-1 et seq. and §17D-1-1 et seq. of this code, relating to registration, title, driver’s license, and financial responsibility requirements” would cause issues as this creates a “No License required” scenario. Should West Virginia be deemed in a state of non-compliance with Title 23 USC 164 IFR-Repeat Offender Rules, the Federal Government could transfer 2.5% ($10.4 million estimated) of federal highways dollars away from the Division of Highways.

Memorandum


The current demand for technical expertise and support on the Division exceeds our current resource level. This bill will require additional technical expertise and support. Therefore, the Division needs to add an Information Systems Manager 1 position at an estimated annual cost of $79,500 (Salary and Benefits) and a Programmer Analyst 3 position at an estimated annual cost of $75,000 (Salary and Benefits).
