Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to eliminate the ability of a person’s driver’s license to be suspended for the failure to pay court fines and costs and to authorize the circuit clerk to record a judgment lien for unpaid fines and costs.
The purpose of this bill is to eliminate the ability of a person’s driver’s license to be suspended for the failure to pay court fines and costs and to authorize the circuit clerk to record a judgement lien for unpaid fines and costs.
The Division processes an average of 29,865 suspensions for failure to pay a citation each year. Costs associated with the processing each suspension include $0.06 for materials and $5.75 in certified postage for a total of $173,516 (($0.06 + $5.75) x 29,865).
The Division collects an average of 18,876 reinstatement fees each year with a fee of $50 per reinstatement for a total of $943,800 (18,876 x $50).
The revenue collected is credited to the Motor Vehicle Fees Fund and used to cover expenses of the Agency’s Driver Services Section. In the absence of this revenue the agency will need to rely on its Road Fund appropriation to cover the costs.
The Division is not in a position to estimate the cost to be incurred by the Counties and Municipalities who will be tasked to collect the judgement liens.

Memorandum
The current demand for technical expertise and support on the Division exceeds our current resource level. This bill will require additional technical expertise and support. Therefore, the Division needs to add an Information Systems Manager 1 position at an estimated annual cost of $79,500 (Salary and Benefits) and a Programmer Analyst 3 position at an estimated annual cost of $75,000 (Salary and Benefits).
