SB492 creates a bonding requirement to reclaim abandoned wind and solar facilities. the implementation of this bill will require DEP to incur additional personnel costs to complete the responsibilities of the bonding requirement. Deposits of penalties and interest income are not expected to be at a self sustaining level for several years, therefore the personnel costs will be incurred on existing DEP accounts until the Wind and Solar Decommissioning Account is at a sustainable level.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.
Upon implementation of SB492, DEP will need to hire one additional employee in the Division of Solid Waste to review decommissioning plans, determine bonding requirements, and maintain data related to bonded facilities. The salary of the employee is expected to be approximately $40,000 plus an estimated 34% taxes and benefits. WV DEP is not expected to receive any revenue from penalties and interest for several years.
