Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to create a pilot program in Cabell County relating to recovery residences as they relate to landlord-tenant law. The proposed legislation tasks the Cabell County recovery residences with reporting non-identifying resident information to the Department of Health and Human Resources' Bureau for Behavioral Health regarding reason for early discharge, eviction, or removal of the resident. The Department's Bureau for Behavioral Health is charged with preparing and submitting to the Joint Committee on Government and Finance a written report which evaluates the effectiveness of the pilot program and to provide recommendations as to whether the program should be continued, reduced, expanded, terminated or otherwise modified. The Department estimates the fiscal impact of this legislation to be $150,000.

Explanation of above estimates (including long-range effect):


In order to implement the legislation as drafted, the Bureau for Behavioral Health projects a cost of $150,000 for the anticipated period of the pilot program. Those costs break down into contractual costs of $120,000 to partner with one of the State's Universities to obtain research and analytical resources to provide direction, evaluation of collected data and preparation of final reports. In addition, the Bureau projects potential costs of up to $30,000 for other administrative and programmatic expenses. Of that $30,000, we are allotting $20,000 for incentives for individuals/residences to report data. All identified costs would be one time depending on the results of the Pilot Program.



Memorandum


The dates in the legislation appear to be from the previous legislative session. The Bureau anticipated a data collection period of May 1, 2023 through May 1, 2024 and a final report date of July 1, 2024 when preparing this fiscal note. It should be noted that the Department's Bureau for Behavioral Health (BBH) is not a regulatory agency for recovery residences in the State. BBH is tasked with providing for an accreditation criteria that is administered via the state NARR Chapter, West Virginia Association of Recovery Residences (WVARR). Recovery residences are also permitted to operate within the State of West Virginia without accreditation if they do not received funding or referrals from the state, so there are Recovery Residences in Cabell County that have no association or contact with either the Bureau or WVARR. Additionally for those residences that are WVARR certified, most of those Recovery Residences operate without funding from BBH or the State. The Bureau believe these circumstances likely create obstacles to enforcing provider reporting and obtaining a full data set from all Cabell County recovery residences, which is why funding was added for incentives that could be used to assist in information collection.
