Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to create the Child Protection Investigations Reform Act; and require notification to a person accused of child abuse or neglect of the person's rights in connection with an investigation conducted by the Department of Human Services. The Department anticipates no fiscal impact as the Bureau for Social Services currently provides a booklet with Child Protective Services Rights.

De minimus costs may be associated with creation and/or updating the CPS rights booklet to be in compliance. Parents and/or guardians in an abuse and neglect referral are currently entitled to records as long as parental rights have not been terminated. The Department typically requests a customary fee of $0.25 a page. The bill does not specify if the department can or cannot charge. The Department does not refer all abuse and neglect referrals to law enforcement, only those that rise to the level of a crime.
