Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

Funding for costs of professional services or socially necessary services rendered to a child or other party to proceedings pursuant to W. Va. Code §49-4-108 is not in the Supreme Court’s budget. West Virginia receives federal funding as reimbursement for certain expenses incurred in providing such services to children and adults under Title IV-E of the Social Security Act. These services are necessary for circuit court findings that reasonable efforts were made or not required to prevent removal of the child, reunify the family, or to finalize permanency. See https://budget.wv.gov/reportsandcharts/federalfunds/Documents/Federal%20Book%20FY%202025.pdf and https://dhhr.wv.gov/bss/policy/Documents/IV-E_Policy_%20Revised_10.25.2019.pdf. The Court is unable to calculate the potential cost to the State from losing Title VI-E funding due to a lack of available services, if services are unavailable because of extended wait lists, or if accessibility barriers keep a parent from receiving the services recommended by an MDT.
