Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to provide the authority to the Commissioner of the Division of Motor Vehicles to issue certain vital records subject to the rules and regulations of the State Registrar, to allow the DMV to collect fees for issuing vital records that will be provided to the State Registrar, and for the Commissioners of the DMV and DH Department of Health to enter into a Memorandum of Understanding to implement a program that allows the DH Department of Health to provide access to certain vital records to the DMV. The Department does not anticipate a fiscal impact related to this legislation as the bill requires the WV Department of Motor Vehicles to transmit the portion of the revenue associated with the vital record to the State Registrar. Therefore, no loss of revenue to the Department of Health. The State Registrar has implemented a database application for vital events that provides access via web.

Memorandum


The bill mentions issuance of divorce records. While Vital Statistics does receive divorce records for inclusion in its yearly vital statistics publication, they do not issue certified copies of the decree.
