Effect this measure will have on costs and revenues of state government.


This bill creates a random drug testing program for members of the Legislature so that members may be tested for illegal drugs during each regular session of the legislature. The program is to be administered by the Legislative Administrator and requires 1 drug test per member per session, and a second test to be administered no less than 30 days following an initial test that indicated the presence of illegal drugs. The only cost increase would be the cost of the drug tests themselves as the administration of this program through the Legislative Administrator can be done with existing resources. Current cost estimates for a drug screen range from $60-$125 depending on test type.

Explanation of above estimates (including long-range effect):


There are 134 members of the legislature subject to potentially 2 drug tests per regular session at a high end estimated cost of $125 per test. The potential maximum annual cost of operating this program would be 134 x $125 x 2 = $33,500. These costs may be less should members be tested less than twice per session, but the bill indicates no member would be tested more than twice per regular session except when a positive test result indicates the presence of illegal drugs. So the assumption was made that two test would be administered per member.
