Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to add grievance and appellate procedures and judicial review for participants in the Division of Motor Vehicles' Safety and Treatment Program. The bill also authorizes the Commissioner of the Division of Motor Vehicles to promulgate rules to add such procedures and review for participants of the safety and treatment program.
The Division estimates that of the 2,350 drivers that are eligible for the Safety and Treatment program 10% (235) will seek to file an appeal. Conducting these hearings will require the Division to have two (2) additional positions. The additional positions would be 1 Hearings Examiner at a median annual salary of $$68,000 and 1 Attorney at a median annual salary of $$99,500. Total benefits for these positions would be $$80,400 for a total personal services expenditure of $247,900 ($68,000+$99,500+$68,000).
Additional annual expenses would include rent of $8,220, vehicle rental $1,632, travel $10,000, and miscellaneous supplies of $40 for a total of $19,892.
The Division estimates that non-recurring costs will total $12,118 and consist of office furniture $7,500, Misc. Office equipment $2,500, and $2,118 for laptop computers.
Additional changes to the Alcohol and Drug Test and Lock Program called for in this bill will not have a financial impact in the Division.
