This proposed legislation changes the minimum amount of insurance that county boards of education must maintain. In its current form, this proposal does not have any estimated cost to the State. However, there is an anticipated savings to the county boards of education since the required amount of insurance coverage is being decreased.

Explanation of above estimates (including long-range effect):


This legislation, in its current form, has no estimated cost to the State. However, there is an anticipated savings to the county boards of education since the required amount of insurance coverage is being decreased. WVDE does not have access to the data necessary to calculate this potential savings. WVDE recommends that the State Board of Risk and Insurance Management (BRIM) be given the opportunity to provide information on the potential fiscal impact of this proposed legislation.



Memorandum


WVDE believes the provisions cited in subsection (C) of this proposed legislation were intended to relate specifically to liability insurance coverage administered by the State Board of Risk and Insurance Management (BRIM) for county boards of education. These matters are currently referenced in § 29-12-5a, which establishes BRIM’s authority and responsibilities for providing insurance coverage to county boards of education and their employees. To ensure statutory consistency, the referenced insurance language should be incorporated into Chapter 29-12-5a rather than Chapter 18-5-19d.
