Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to establish the West Virginia Clean Air in Schools Act of 2026. This would affect WV Department of Health's, Bureau for Public Health's Office of Environmental Health Services by requiring a staff member to research and define parameters for indoor air pollutants named in the bill. It would also require a staff member to review submitted corrective action plans from the school. It is unknown how many reviews would be submitted in any given period. Also, it does not identify a funding source. The Department estimates the fiscal impact for this legislation to be $101,541 the initial year and $87,005 ongoing.

Explanation of above estimates (including long-range effect):


Additional staff would be required for Radiation Toxics and Indoor Air (RTIA) to research and create guidelines for the school's IAQ monitoring as well as review and be the subject matter expert for an unknown quantity of corrective action plans. An Environmental Resource Specialist 2 at $86,225 ($63,870 salary plus $22,355 fringes at 35%) would be needed to manage the case load. Current expense cost total $15,316 first year (power laptop $1,010, extended warranty on power laptops $181, two monitors (24 inch) $288 @ $144 each, cell phone and accessories at $57.00 (one time cost), cell phone service of $780 (ongoing cost $65 per month), and six program IAQ meters at $1,000 each ($6,000), travel and training (out of state $2,000 & in-state $5,000) for staff estimated at $7,000). This is based on other programs known costs for training/travel. Ongoing cost estimates would total $780, which includes the phones service.

It is unknown at this time if a staff member in the Department of Education, the Department of Health or both would be responsible for reviewing corrective action plans nor is it known how many plans will be submitted yearly.
