Memorandum
Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form.
The following contains the Authority’s concerns with the amendment contained within this Bill.
• House Bill 4518 amends and reenacts §17-16D-15 and §17A-4-1 of the Code of West Virginia, 1931, stating in relevant part that “[t]he Authority and the Division shall create a procedure where the Division shall provide the Authority updated information when any person utilizing the single fee discount plan updates their vehicle's information.”
• As drafted, this House Bill is vague and the Authority is unclear as to what issues and requirements, if any, would be addressed in any such procedure created between the Authority and the Division of Motor Vehicles.
• As required by the Dormant Commerce Clause of the United States Constitution, and consistent with the Tolling Policy and Toll Rate Schedule currently in effect, the Authority would note that the single fee discount plan is available to eligible customers outside of the State of West Virginia and, in fact, many out-of-state vehicles participate in the single fee discount program. Accordingly, it is our understanding that the Division of Motor Vehicles would not be able to provide updated information for such out-of-state vehicles.
• While the fiscal impact of House Bill 4518 remains uncertain, the procedure described therein could increase the administrative costs of the Authority and the Division of Motor Vehicles.
• Further, the Authority already has a simple process for customers to update their vehicle information under the single fee discount program. Currently, any customer may (i) manage their EZPass account update their vehicle information through the available online portal (www.ezpasswv.com), which is also linked through the Authority’s website (https://transportation.wv.gov/Turnpike/Pages/default.aspx), or (ii) call the EZPass Customer Service number (1-800-206-6222). If the Authority was obligated to change EZPass vehicle information solely based on information passed along by the Division of Motor Vehicles, without the input and consent of its customers, this could result in (a) unintended or erroneous updates to its customers’ EZPass accounts and vehicle information and/or (b) tolls, charges or fees imposed on customers whose vehicle information was changed without their input or consent.
