Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


Passage of SB495 with its proposed addition of W. Va. Code §22-37-1, et seq. will affect expenditures for the DEP as provided in this fiscal note. The fiscal note does not include any revenues or expenditures for any county or other authority designated by the county commission, local health department, or any other state or local law-enforcement agency. Other government entities may incur costs to permit the units as required by §22-37-8 or to enforce the provisions. Likewise, the fiscal note does not include any expenditures related to the cost for residents who own existing grandfathered units to retrofit appliances with a stack to meet the requirements of §22-37-7, to obtain a permit to meet the requirements of §22-37-8, or related to possible increases in fuel costs if they cannot operate the appliances outside the seasonal use defined in §22-37-6(d).

Explanation of above estimates (including long-range effect):


The anticipated information technology costs to DEP are based on a conservative estimate which includes functionality to implement all aspects to issue permits (per §22-37-8a), receive annual certifications and reports (per §§22-37-8c and -7d), and conducting inspections and writing citations (per §22-37-9). This would require 5 new forms/applications (Permit, Annual Certification, Voluntary Report, Inspection/Investigation, Citation), updating the existing complain processes to handle these types of issues, and developing a dashboard or report for the statistics required in the legislative report (per §22-37-11(e)). One FTE would be required to implement the revisions and 0.5 FTE would be required to maintain the systems based on an average salary with fringe benefits of $78,000/FTE. Additional non-IT related expenses for rulemaking, reporting, and enforcing the provisions beyond the existing budget are not anticipated.
