This proposed legislation creates a community school support fund that requires the State Superintendent of Schools to take certain actions to set aside $5 million for the fund and clarifies the application process for assistance from the fund.
This legislation, in its current form, has no additional estimated cost to the State. Under the proposed legislation, it appears as though the intent is for a portion of current State funding to be reallocated for the purpose of creating a community school support fund.

Explanation of above estimates (including long-range effect):
This legislation, in its current form, has no additional estimated cost to the State. Under the proposed legislation, it appears as though the intent is for a portion of current State funding to be reallocated for the purpose of creating a community school support fund.
This reallocation may have secondary impacts on existing programs, depending on how savings are identified and sustained.
This legislation also authorizes the Superintendent to utilize current Step 7 funds under the Public School Support Plan (PSSP) for personnel, facility operation, and other necessary expenses related to sustaining qualifying schools. It is the assumption of the WVDE that this portion of the proposed legislation refers to the State Superintendent. These funds are currently provided to the counties in a block grant; therefore, county boards of education have the flexibility to utilize these funds in the manner referenced. More clarity should be provided to determine the intent of this portion of the proposed legislation.
Memorandum
The legislation, in its current form, states that county boards of education eligible for these funds would be exempt from compliance with the school funding formula regarding professional and service personnel. WVDE suggests that the legislation be more specific as to what compliance factors the county board would be exempt from.
When addressing the ability to use Step 7 funds toward cost of personnel, operation of facility, and other necessary expenses, the legislation does not make clear whether that decision would rest with the county superintendent or the State superintendent. County boards of education typically retain fiscal and operational authority over funding allocation decisions.
