Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to require the Office of Health Facility Licensure and Certification to inspect office-based medication-assisted treatment programs at least every 24 months. This bill instructs the Office of Health Facility Licensure and Certification (OHFLAC) to perform formal inspections of office-based medication-assisted treatment (OBMAT) programs at least once every 24 months, including a review of patient records. This is an existing facility type that is subject to unannounced complaint and verification inspections by OHFLAC. Therefore, this bill does not create a new program. According to current records, 102 OBMAT facilities operate within the state of West Virginia that will be subject to formal inspections every 24 months. In order to conduct these inspections, it is estimated that OHFLAC will need 0.5 FTE Health Facilities Surveyor 1 to perofrm the required surveys and reviews. However, the overall economic impact of the bill cannot be definitively stated as the amount of expenses required to implement and the manage the review and survey of this additional facility-type and to provide clerical and financial support is unknown.

Explanation of above estimates (including long-range effect):


The estimated cost of this legislation to the Office of Inspector General's (OIG) Office of Health Facility Licensure and Certification (OHFLAC) is $53,687 in FY 2027 and upon full implementation. It is anticipated that OHFLAC will need an additional 0.5 FTE Health Facilities Surveyor 1. The annual estimated costs of the additional 0.5 FTE is $40,187 for personal services ((sum of State average salary $52,730 and fringe benefits $27,644) x 0.5 FTE) and $13,500 for current expenses (including rent, utilities, office supplies, training at $1,000 and travel at $12,500). This totals to a FY 2027 estimated cost of $53,687 that will continue upon full implementation.
