Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. The Commission contends the bill will have no effect on the revenues or expenses of the Commission or the State of West Virginia.



Memorandum


Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form. The proposed bill removes the requirement that one of the commissioners be an attorney with 10 years of experience. The Commission acts as a quasi-judicial regulatory agency which conducts hearings governed by evidentiary and procedural rules and issues orders that require findings of fact and conclusions of law in complex utility cases. During the hearings and during deliberations the Commission frequently has to rule on procedural, evidentiary and substantive legal issues that affect the outcome of the case. Conducting hearings and deliberations and reviewing orders without an experienced attorney on the Commission could be problematic.
