Effect this measure will have on costs and revenues of state government.
This bill creates three new acts addressing foreign adversary activities: the Foreign Adversary Contracting Prohibition Act, the Foreign Adversary and Terrorist Agent Registration Act, and the Transnational Repression Act. Higher education institutions, defined as "public entities," are prohibited from contracting with "scrutinized companies" or "foreign adversarial companies" for technology-related products or services and must obtain vendor certifications prior to awarding contracts. Any student, faculty member, researcher, adjunct, or other employee/associate found in violation of the Foreign Adversary and Terrorist Agent Registration Act may be expelled, dismissed, or prohibited from entering any West Virginia campus. Each postsecondary institution must adopt policies regarding expulsion and dismissal of violators and establish appropriate institutional responses to violations.

Explanation of above estimates (including long-range effect):
Institutions will incur costs for developing required policies, establishing compliance procedures, educating students and staff on new requirements, and reviewing both existing and future contracts for compliance. While these policy development and education costs are to be expected, accurate cost estimates cannot be determined for several key fiscal impact areas. The potential expense of canceling and reissuing existing contracts that do not meet new requirements is unknown and depends on the number and value of affected contracts with scrutinized companies. Additionally, ongoing compliance monitoring costs cannot be estimated, particularly expenses associated with tracking and managing interactions with foreign students, faculty, and collaborative research arrangements, as the scope and frequency of required monitoring activities are unknown. The actual fiscal impact will vary significantly by institution based on the extent of existing foreign partnerships, technology contracts, and international student/faculty populations.
