Effect this measure will have on costs and revenues of state government.
In regard to the Chapter 33 provisions of House Bill 5349, with only a few minor variations, the provisions of House Bill 5349 are already in, and duplicative of, existing state code sections regarding mental health parity that were previously passed by the West Virginia Legislature in Senate Bill 291 (2020), and signed into law by the Governor on March 25, 2020.
HB5349 would not have additional fiscal impact on the WVOIC as these duties and functions have already been absorbed by the agency in 2020.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.
Memorandum
House Bill 5349,if enacted, requires the Public Employees Agency and other health insurance providers to provide mental health parity. As currently drafted, the amendments of the identified articles of Chapter 33 would have duplicative sections on mental health parity.
As noted in the Fiscal Note Summary, the provisions of House Bill 5349 are already in, and duplicative of, existing state code sections regarding mental health parity that were enacted by the West Virginia Legislature in Senate Bill 291 (2020).
As such, the OIC does not estimate any additional fiscal impact from HB5349, since those proposed provisions are already in state code and the OIC is already preparing the annual report for the Joint Committee on Government and Finance required by HB5349.
House Bill 5349 does appear to extend existing mental health parity laws that are applicable to private health insurers to PEIA. Therefore, PEIA should be consulted on any fiscal impact to their agency.
