Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to regulate private alternative adolescent residential or outdoor programs by the Director of the Office of Health Facility Licensure and Certification.
This bill instructs the Director of the Office of Health Facilities Licensure and Certification (OHFLAC) to regulate and license private alternative adolescent residential or outdoor programs. Although this is a new facility type that is not currently licensed by OHFLAC, it is anticipated that this facility-type will be embedded within an existing program at OHFLAC. Therefore, this bill does not create a new program.
According to the WV Division of Corrections & Rehabilitation website, ten juvenile facilities and 21 reporting centers operate within West Virginia. This bill requires the Inspector General to develop and promulgate rules for these facilities "in order to ensure adequate care and accommodations for consumers of programs." Currently, the rules related to this new facility type have not yet been developed and the annual licensure fee per facility and other factors have not been determined. As such, the full impact on revenues and expenses is unknown at this time.
In order to annually license the private alternative adolescent residential or outdoor programs currently operating in WV, it is estimated that OHFLAC will need 0.5 FTE Health Facilities Surveyor 1 to perform the required surveys and reviews. However, the overall economic impact of the bill cannot be definitively stated as the amount of expenses required to implement and manage the review and survey of this additional facility-type and to provide clerical and financial support is unknown. Additionally, an estimate of costs cannot be determined for complaint investigations, report writing, plan of correction reviews, and other tasks due to uncertainties in the scope and severity of the violations or deficiencies.

Explanation of above estimates (including long-range effect):
The estimated cost of this legislation to the Office of Inspector General's (OIG) Office of Health Facility Licensure and Certification (OHFLAC) is $53,687 in FY 2027 and upon full implementation.
It is anticipated that OHFLAC will need an additional 0.5 FTE Health Facilities Surveyor 1. The annual estimated costs of the additional 0.5 FTE is $40,187 for personal services ((sum of State average salary $52,730 and fringe benefits $27,644) x 0.5 FTE) and $13,500 for current expenses (including rent, utilities, office supplies, training at $1,000 and travel at $12,500). This totals to a FY 2027 estimated cost of $53,687 that will continue upon full implementation.
Currently, the rules related to this new facility type have not yet been developed and the annual licensure fee per facility and other factors have not been determined. As such, the full impact on revenues and expenses is unkonwn at this time.
