Effect this measure will have on costs and revenues of state government.


SB226 as introduced would exclude persons selling products or commodities produced exclusively on their own farm from the definition of 'distributor' and thus not be required to obtain a Commercial Feed Distributor Permit in WV. The Department of Agriculture anticipates no increase in expense related to this bill and minimal, if any, revenue loss, but cannot estimate at this time as the number of current Distributors who may qualify for this exemption are unknown. The Committee Substitute for SB226 would allow farmers to manufacture feeds of their own commodities on farm. The farmer is allowed to sell up to 30 tons a year without a permit fee or tonnage fees. Each farmer manufacturing and selling feed of their own farm must register annually with the WV Department of Agriculture. All feed must be labeled correctly. This bill would not affect revenue and have minimal costs to the State.

Explanation of above estimates (including long-range effect):


As introduced, SB226 would not increase costs to the State and would have minimal revenue loss that can not be estimated at this time as it is unknown how many current distributors would qualify for the exemption. The above number reflect impacts for the CS. Permit fees and tonnage are not being paid to the state currently, so the bill would not affect revenue for the State for on-farm manufacturer registrations. Cost estimates above are the for the personnel time for Registration Specialists at the WV Department of Agriculture to register and mail permits to the new manufacturer and any inspections required by WV Department of Agriculture Regulatory Officers to check labeling, facility, and any complaints for the new manufacturers.
