Memorandum
Senate Bill 884, if enacted, requires coverage treatment of pediatric autoimmune neuropsychiatric disorders associated with streptococcal infections; requires coverage for treatment of pediatric acute onset neuropsychiatric syndrome; requires a prior authorization to be obtained; and requires that a physician demonstrate that all other treatments have been exhausted.
SB884 may impact insurance premium rates in the private market.
There is no fiscal impact to the WV Offices of the Insurance Commissioner.
It should be noted that SB884 does not contain language limiting the insurance benefits provided under the proposed bill to the essential health benefits (EHB) specified under section 130(b) of the Patient Protection and Affordable Care Act (PPACA). PPACA1311 (d)(3) provides that a state must defray the cost by direct payment to enrollees or to the Plan of any state mandated benefit in excess of the EHB. To the extent that the health insurance benefits required by SB884 do not fall within the EHB, a potential cost to the State exists.
As this bill amends their respective Code sections, it is recommended that PEIA and BMS be consulted regarding the fiscal impact on their programs.
