Senate Bill 860 amends W.Va. Code §15-11-1 and §15-11-2 relating to the payment of funeral expenses for law-enforcement, safety, and emergency workers. The primary purpose is to align the statute's language with W.Va. Code §5H-1-2(b) regarding survivor's benefits.

Explanation of above estimates (including long-range effect):


Current funding historically provides for four (4) instances of eligible line-of-duty deaths per year ($32,000). Because it's hard to predict line-of-duty deaths and the bill broadens the definition of eligibility from being "killed" to dying "as a proximate result" of official duties, we estimate an increase of two (2) additional eligible instances annually. Total Projected Instances: Six (6) eligible instances per year. Maximum Cost Per Instance: $8,000. Current Budgeted amount: 4 instances x $8,000 = $32,000 Projected Annual Cost under SB 860: 6 instances x $8,000 = $48,000 Net Estimated Increase in Fiscal Impact: $16,000 per fiscal year. This legislation will not incur additional administrative costs. Furthermore, no additional funding is required for Fiscal Year 2026, as existing fund balances are sufficient to absorb the projected cost increases associated with this bill.



Memorandum


The definition and determination of proximate result may need to be spelled out in the bill. Proximate result refers to an outcome that occurs as a direct, foreseeable consequence of duty or service. It is currently not possible to project the actual costs associated with these changes. We may need to revisit this matter in the future if the account balance is depleted.
