Memorandum
The term "out-of-state" vendors is vague as it does not specify the degree of presence a vendor must have in WV to qualify. For example, it does not specify if a vendor would qualify by having a headquarters in WV, maintaining a principal place of business in WV, or merely maintaining an active registration with the Secretary of State.
If clarity were to be provided, this bill would still be expected to have a material and negative impact on DOH budget which currently pursues "best value" (amongst other) as the driver for contract and vendor awards.
