This piece of legislation would require the State Police to pay for the incarceration of inmates arrested by the State Police. The total estimated fiscal impact for this bill is $16,476,519. The West Virginia State Police would require full funding for this bill as we do not have the resources for this obligation.

Explanation of above estimates (including long-range effect):


Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. The West Virginia State Police accounts for 25% of arrests statewide. The total anticipated number of days to be billed for incarceration of inmates statewide for FY2025 is 970,701 per the Asst. Director of Fiscal Operations for DHS/DAS. The daily rate for FY2026 is $67.27 making the projected State Police portion approximately $16,324,764. This amount would change from year to year depending on these variables. The cost of two civilian accounting staff is included in this fiscal note to audit billings, help with record keeping and the fiscal management of these expenditures.

We are noting that as this legislation is worded, the State Police would be responsible to pay for the incarceration of inmates in cases where we are only executing other agencies’ arrest warrants.
