Effect this measure will have on costs and revenues of state government.


SB 522 would have a minimal fiscal impact on the Division of Labor in the long term because it does not materially alter the Division’s existing enforcement responsibilities pursuant to the Verifying Legal Employment Status of Workers statute, W. Va. Code §21-1B-1 et seq. However, the Division is likely to incur some administrative costs in the short term because SB 522 would require all employers in the state to be enrolled in E-Verify by July 1, 2026 and would require the Division to provide technical assistance, training resources, and guidance to employers to support compliance. Therefore, in anticipation of an influx of employers seeking guidance from the Division prior to SB 522’s effective date of July 1, 2026, the Division may need to hire temporary/seasonal employees to assist the agency in such efforts.
