Explanation of above estimates (including long-range effect):
The Division would have a variable cost but would be required to pay out 15% of every
condemnation order, whether that is an award by a jury or a settlement order, to its
respective county. Amounts vary due to the nature of the case and the amount of
property being taken and can range anywhere from $500 to millions of dollars. The
Division estimates that it resolves approximately 100-200 eminent domain proceedings
by court order each year.
Memorandum
The Division would be required to pay an additional 15% of any amount entered by
court order of an eminent domain proceeding to the county where the property is being
located.
