Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. The WVDCR cannot quantify the fiscal impact that this DRAFT legislation may have. The agency does not see any additional spending as a fiscal impact. The agency currently has staff in place that perform similar duties to fulfill other statutory obligations (example - providing the necessary reports mentioned in the legislation). There is, however, a possibility for a positive impact on general revenue expenses. Anytime an offender's incarceration time is reduced, there is a positive impact. The cost to house in a prison facility is $132.74 per day. The below statistics give some context to the offender population that have served 10 years or more on their sentence: The number of individuals who have served 10 years or more and have a sentence of more than a 10 years but not a life sentence is 621. The number of individuals who have served 10 years or more and have a sentence of more than a 10 year, life w mercy, or habitual life but not a life w/out sentence is 824. The number of individuals who have served 10 years or more and have a sentence of more than 10 year, life w mercy, habitual life, or life w/out sentence is 1059.
