The WVDCR cannot quantify the fiscal impact that this DRAFT legislation may have. The agency does not see any additional spending as a fiscal impact. The agency currently has staff in place that perform similar duties to fulfill other statutory obligations (example - providing the necessary reports mentioned in the legislation). There is, however, a possibility for a positive impact on general revenue expenses. Anytime an offender's incarceration time is reduced, there is a positive impact. The cost to house in a prison facility is $132.74 per day. The below statistics give some context to the offender population that have served 10 years or more on their sentence:
The number of individuals who have served 10 years or more and have a sentence of more than a 10 years but not a life sentence is 621.
The number of individuals who have served 10 years or more and have a sentence of more than a 10 year, life w mercy, or habitual life but not a life w/out sentence is 824.
The number of individuals who have served 10 years or more and have a sentence of more than 10 year, life w mercy, habitual life, or life w/out sentence is 1059.
