Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to ensure that covered persons who are stable on their biological product prescription drug regimens, as determined by the prescribing provider, have continuous care and that third-party payers cannot make restrictive changes to their formularies after a plan year has begun or has been renewed, resulting in increased cost-sharing or loss of access to a medication—a practice referred to as “nonmedical switching.” The Department of Health and Human Resources (DHHR) anticipates no or de minimis change in costs associated with passage of the bill.

Memorandum


The DHHR's Bureau for Public Health indicates that passage of this bill could potentially result in cost savings for the Ryan White program for HIV care/services. This program covers medication costs for HIV positive individuals who are not able to pay themselves. If an HIV positive person is subject to non-medical switching and can no longer afford their medication, they become eligible for the Ryan White program to cover the cost. The DHHR's Bureau for Behavioral Health and the Office of Health Facilities indicate that passage of this bill could have some positive effects for patients and charity care; but there is no discernable way to determine to what extent. Please note that the cross reference on page 1 of the introduced bill is incorrect. It lists 42 U.S.C. § 2262, but should be 42 U.S.C § 262.
