Explanation of above estimates (including long-range effect):
Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years.
The office of Administrative Hearings provides a neutral tribunal for the adjudication on contested driver's license revocation proceeding initiated by the Division of Motor Vehicles due to incidents that occurred prior to July 1 2020. While the passage of SB261 would increase the jurisdiction of the Office of Hearings, the impact to the Agency would be minimal. The Agency estimates that the passage of this Bill would increase the number of overall case filings by no more than five per year. These cases can be absorbed into the Agency's current caseload without any additional cost in FY2021.
However, due to the enactment of SB130 in March of 2020, the Office of Administrative Hearings is being phased out and will permanently close no later than July 1, 2021. The enactment of SB261, as currently written, will not extend the life of the Agency beyond its current termination; therefore, no data is provided beyond the current fiscal year as the Agency will no longer be in existence.
