Effect this measure will have on costs and revenues of state government.


Generally, HB2562 restructures and clarifies litter violators in WV Code 22-15A-4, and creates WV Code 22-15A-4A to clarify the fines and penalties for those found guilty of littering. Litter fine amounts have been adjusted to a broader range, with the most significant being the reduction of the fine related to littering on the waters of WV, which reduces the minimum fine from $500 to $100. WV DEP does not expect a significant increase or decrease in the annual revenues or expenditures in the Litter Control Program.

Explanation of above estimates (including long-range effect):


The Litter Control Fund currently receives approximately $21,000 annually from litter penalties. This average is based on the previous three years of collections and is not expected to increase. The Fund is required to expend at least 30% of the funds for litter control grants to municipalities and county governments for the initiation and administration of local litter programs. These grants are awarded at a maximum of $5,000 per grant. Due to the limited funding received in the Fund, WV DEP has historically expended 100% of the annual funds received for grant awards to maximize, to the extent possible, litter control programs throughout the State.

WV DEP believes that the verification of community service completed by violators, as stated in 22-15A-4A(e) of the bill, should be verified by the issuing authority, not solely by WV DEP environmental inspectors.
