Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. The Division of Personnel (DOP) believes that the bill creates a duplicative program within state government by creating two (2) separate merit systems. The proposed Department of Transportation (DOT) merit system would not apply to other agencies in the classified service and would cause issues with classified employees within DOT transferring or otherwise changing employment to another agency within the classified service to include transfer or acceptance of dissimilar benefits. The DOP also believes that a Board separate from the State Personnel Board would have to be created to provide oversight of the merit system within DOT.

Explanation of above estimates (including long-range effect):


Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. The DOP currently administers the entire merit system that applies to approximately 20,000 classified employees with a staff of only 52 employees. DOT currently administers only the hiring, classification and compensation elements for Division of Highways (DOH) employees but has a human resource staff of approximately 50. It is unclear how creating a separate system would achieve efficiencies or how the existing DOP merit system does not meet the needs of DOT.

No areas of vagueness or technical defects have been identified. Special issues not captured elsewhere on this form include: 1. Multiple merit systems within state government creates disparity among employees of the classified service. 2. Reciprocity pertaining to tenure, leave accrual, preference hiring after layoff and other benefits would not exist among agencies within the classified service. 3. DOT employees could or should not transfer from one merit system to another and would therefore be required to be hired from a register for positions at other agencies. 4. The entirety of state code includes references to “classified”, “classified-exempt”, “exempt”, “merit system” and similar terminology that would be complicated by the existence of a separate merit system.
