The purpose of this bill is to require physicians notify parents when prescribing contraceptives to minors. Programs funded by Federal Title X Family Planning Program are required to serve adolescents. Per 42 CFR § 59.2, unemancipated minors that wish to receive services on a confidential basis must be considered on the basis of their own resources, provided that the Title X provider has documented in the minor's medical records the specific actions taken by the provider to encourage the minor to involve family (including parents or guardians) in the decision to seek family planning services, except that documentation of such encouragement is not to be required if the Title X provider has documented in the medical record: 1) that it suspects the minor to be the victim of child abuse or incest; and 2) that it has, consistent with and if permitted or required by, applicable State or local law, reported the situation to the relevant authorities. The passage of SB118 could potentially disqualify the Department's Office of Maternal Child and Family Health (OMCFH) from receiving $2,021,000 in federal funds in FY2022 and ongoing, assuming an effective date of July 1, 2021. The Title X Family Planning Program provided 32,430 unique individuals services during CY2020. Disqualification from Title X funding could potentially have a negative impact on the obligatory statewide plan required by West Virginia Code (§16-2B-1) to reduce incidences of fetal exposure to illicit substances by increasing the number of clients served and enabling access to long-acting reversible contraceptive (LARC) and other family planning methods.
